These website terms of use (the “Terms of Use”) govern your use of www.goldjewellery.ie (the “Website”), which is operated by The Quality Gold Jewellery Company Limited (trading as GoldJewellery.ie), registered in the Republic of Ireland (company number 675311) with its registered office at Rathmore 2, Four Mile House, Roscommon, Roscommon, Ireland (“we”, “us”, “our”).

Please read these terms carefully before using the Website (including accessing and browsing). By using the Website, you indicate that you accept and agree to comply with these Terms of Use. If you do not agree, you must not use the Website.

We (or our licensors) own all intellectual property rights in the Website and the material published on it, including software, design, text, images, photographs, audio/video clips, artwork and graphics, and their selection and arrangement. All rights are reserved.

You may print one copy and download extracts of pages for personal use. You must not modify copies or use images, audio or video separately from accompanying text. Our status (and that of any identified contributors) as authors must be acknowledged. You must not use any part of the content for commercial purposes without our prior written licence.

3.9 Uploading Content

If you upload content or contact other users through the Website, you must comply with section 3.6 (Acceptable Use). You warrant compliance and will be liable to us for any loss or damage arising from breach. Content you upload will be considered non-confidential and non-proprietary; we may use, copy, distribute and disclose it to third parties for any purpose. We may disclose your identity to third parties who claim content you posted infringes their rights or where required by law. We may remove any posting that does not comply with these standards. Views expressed by users do not represent our views.

3.10 Third-Party Materials

The Website may include materials from third parties and links to third-party websites. We are not responsible for examining or evaluating third-party content or websites and do not warrant or accept liability for them. Access at your own risk.

3.11 Limitation of Liability

Nothing in these Terms of Use excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under Irish law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Website or any content on it, whether express or implied. We will not be liable for any loss or damage arising from use of, or inability to use, the Website or reliance on content, including loss caused by viruses, distributed denial-of-service attacks or other harmful material that may infect your equipment, programs, data or other proprietary material.

The Website is provided for domestic and private use. You agree not to use it for commercial or business purposes and we have no liability for loss of profit, business, business interruption, or business opportunity.

3.12 Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Republic of Ireland. The Irish courts shall have non-exclusive jurisdiction.

4. Terms and Conditions for the Sale of Goods Online

4.1 Introduction

This Website, www.goldjewellery.ie, is operated by The Quality Gold Jewellery Company Limited (trading as GoldJewellery.ie), registered in the Republic of Ireland (company number 675311), with its registered office at Rathmore 2, Four Mile House, Roscommon, Roscommon, Ireland.

In these Terms, “we”, “us”, “our” refer to The Quality Gold Jewellery Company Limited trading as GoldJewellery.ie, and “you” refers to the customer.

These Terms and any Contract between us are in the English language.

We process personal data as described in our Privacy Policy.

Please see section 4.8 (Your Right to Cancel) for information on your legal right to cancel under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.

4.2 Definitions

  • “Bespoke Items”: goods made-to-measure, to your specification, customised or personalised (including engraved jewellery).

  • “Contract”: the contract for purchase and sale of the Goods through the Website formed in accordance with section 4.4.

  • “Goods”: products (including, without limitation, jewellery, rings and watches) available for sale through the Website.

  • “Event Outside Our Control”: any act or event beyond our reasonable control, including strikes, civil commotion, terrorism, war, fire, flood, epidemic, natural disaster, or failure of telecommunications/transport networks.

  • “Order”: an order for Goods submitted through the Website using our online ordering system.

  • “Terms”: these terms and conditions of sale.

4.3 Placing an Online Order

To place an Order you must be a consumer and over 18 years of age. If purchasing on behalf of a business, please contact us.

When you place an Order, these Terms apply. By clicking “Place your order” you are offering to buy the Goods and are obliged to pay at that point. If we accept your Order, these Terms form the basis of the Contract (see section 4.4). We do not file the Contract; please print or save these Terms and your Dispatch Email.

Ensure your Order details are correct. Our process allows you to check and amend errors before submitting. The Order Review screen will show key details including Goods, total price (inclusive of taxes) and delivery charges.

4.4 How a Contract Is Formed Between Us

After you place an Order, we send an acknowledgement email. This acknowledges receipt only and is not acceptance. We are not obliged to accept your Order and no contract exists at this stage.

We accept your Order by sending an email confirming the Goods, total value and that the Goods have been (or will be) dispatched (the “Dispatch Email”). The Contract is formed when we send the Dispatch Email.

If we cannot supply Goods (e.g., out of stock, discontinued, pricing error), we will inform you and will not process the Order. If applicable, we will refund payments made.

4.5 Our Goods

Images and videos of Goods on the Website are for illustrative purposes. We use reasonable efforts to represent Goods accurately, but displays may not reflect actual colours and sizes.

For the Contract, the quantity, quality (where applicable), description and specifications will be set out in the Dispatch Email.

We may alter Goods or specifications if required by law or for minor technical adjustments that do not materially affect quality or performance. If a material change is required, we will notify you and pause processing until you confirm.

As a consumer, you have legal rights regarding faulty or misdescribed Goods. These rights are not affected by these Terms. Some Goods may also carry a manufacturer’s guarantee; contact us for details where applicable.

4.6 Delivery

We will use reasonable efforts to meet the estimated delivery timeframe in your Dispatch Email and, in any case, within 30 days of the Dispatch Email, delivering to the address stated therein. Dates are estimates and may be affected by an Event Outside Our Control. If we are unable to meet the estimate, we will provide a revised date.

You may cancel the Contract if:

  • We refuse to deliver;

  • Delivery within the deadline was essential (taking all circumstances into account); or

  • You told us before we accepted your Order that delivery by a specific date was essential.

The Goods are your responsibility from delivery. Ownership passes to you once we receive payment in full (including delivery charges).

International Delivery
Orders delivered outside the Republic of Ireland may be subject to import duties/taxes payable on arrival. We cannot control or predict these charges. Please check and pay any applicable import duties/taxes. You must comply with destination country laws and restrictions. Manufacturer warranties, service options, standards or labelling may vary by country. Exchange rates and any bank/issuer fees are set by your payment provider.

4.7 Price and Payment

Prices shown on the Website include VAT and applicable taxes at the current rate. We use reasonable efforts to ensure prices are accurate. If there is a pricing error, we will contact you to reconfirm your Order at the correct price or allow cancellation.

Payment is due when placing the Order. Accepted methods are shown at checkout (e.g., credit/debit card, Apple Pay, PayPal). By submitting payment details you confirm you are authorised to use the method and authorise us to charge all amounts due.

You may be subject to validation checks and third-party authorisations. Even after Contract formation, if a pricing error is obvious and could reasonably have been recognised as such, we are not obliged to supply at the incorrect price.

Note: Certain third-party finance options (e.g., “pay in instalments”) may be offered at checkout from time to time, subject to their separate terms. Availability is not guaranteed.

4.8 Your Right to Cancel (Cooling-Off)

If you are a consumer, you have a legal right to cancel under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.

You may cancel from the date of the Dispatch Email until 14 calendar days after:

  • the day the Goods are delivered to you; or

  • if items in your Order are delivered separately, the day the last item is delivered.

Exceptions: The right to cancel does not apply to Bespoke Items or Goods sealed for hygiene or health protection (e.g., earrings or other pierced items) once unsealed.

Refunds on cancellation:

  • We will refund the price paid for Goods, less any reduction for handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods (as in a shop).

  • Refunds will be made without undue delay and no later than:

    • 14 days after we receive the Goods back; or

    • 14 days after you provide evidence of having sent the Goods back; or

    • 14 days after you inform us of cancellation if Goods were not yet dispatched or we offered to collect them.

Refunds will be made to your original payment method. If you used vouchers, we may refund in vouchers.

Returns after cancellation:

  • Return Goods to: Returns, GoldJewellery.ie, The Quality Gold Jewellery Company Limited, Rathmore 2, Four Mile House, Roscommon, Roscommon, Ireland within 14 days of notifying cancellation.

  • Unless the Goods are faulty or misdescribed, you are responsible for return costs. If we agree to collect, we may charge our direct collection costs.

Because you are a consumer, we are under a legal duty to supply Goods that conform with the Contract. Your legal rights are not affected.

4.8.1 Fair Use Policy

We reserve the right to suspend customer accounts and/or refuse orders if we suspect misuse of our returns process (e.g., fraud, excessive return rates far above typical patterns, or unusual activity).

4.9 Cancellation by Us

We may cancel a Contract (in whole or part) if the Goods are withdrawn or unavailable (e.g., by the manufacturer or due to regulatory reasons). We will notify you and refund payments made for the affected Goods.

4.10 Returns (Change of Mind)

Without prejudice to your statutory rights and the cooling-off right above, we offer a 14-day money-back guarantee for non-Bespoke, non-hygiene-sealed Goods returned in original condition and packaging with dispatch paperwork. Items returned after 14 days but within 30 days of delivery may, at our discretion, be exchanged if the same conditions are met.

Before returning, please email info@goldjewellery.ie for guidance. We strongly recommend using a tracked (“signed-for”) service with appropriate insurance. We are not responsible for items lost in transit.

Some Goods may carry a manufacturer’s guarantee in addition to your legal rights. If you believe an item is faulty, contact info@goldjewellery.ie as soon as possible. If within the manufacturer’s guarantee period, we may return the item to the manufacturer for assessment and will inform you of the outcome.

Refunds are issued only to the original payment method.

4.11 Our Liability

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or negligence. We are not responsible for loss or damage that is not foreseeable.

Nothing in these Terms limits your statutory rights.

4.12 Refund Timelines

We endeavour to process refunds:

  • If we do not accept your Order: within 30 calendar days of notifying you.

  • If you return items under section 4.10 and conditions are met: within 30 calendar days of receiving the returned Goods.

  • If you cancel under section 4.8: within the timelines stated in 4.8.

Bank processing times vary; it may take up to 7 working days (or per your provider’s timelines) for funds to appear.

4.13 Special/Bespoke Orders

Bespoke Items (e.g., custom sizes, engravings, made-to-order designs) typically require additional lead time which will be advised at purchase. Bespoke Items cannot be cancelled, returned or refunded unless faulty.

4.14 Sale Items

  • Sale items may be available for a limited time and while stocks last.

  • Sale pricing may reflect alternative packaging.

  • Sale items cannot be combined with other offers unless expressly stated.

  • Delivery times remain subject to availability.

4.15 Pre-Owned Items

Where we offer pre-owned items, details of any inspection, servicing and warranty (if applicable) will be stated on the product page at the time of purchase. If you change your mind within 7 days of receipt, please email info@goldjewellery.ie for assistance. This does not affect your statutory rights.

4.16 Gift Vouchers & Gift Cards

4.16.1 Gift Vouchers

  • GoldJewellery.ie Gift Vouchers may be purchased online and/or (where available) in person.

  • Vouchers are not a cheque guarantee, credit or charge card.

  • Multiple vouchers may be purchased in one transaction; redemption limits (if any) will be stated at checkout.

  • Vouchers are non-refundable and not exchangeable for cash. No change is given; any balance remains for future purchases.

  • Vouchers are valid for 5 years from date of issue.

  • Keep vouchers safe; lost/stolen/damaged vouchers cannot be replaced.

  • We may amend voucher terms with reasonable notice where necessary.

  • Irish law and courts apply.

4.16.2 Gift Cards

If/when physical Gift Cards are offered, equivalent terms to vouchers apply unless stated otherwise. Any channel limitations (e.g., in-store only) will be stated at purchase.

4.17 Other Important Legal Terms

We are not responsible for failure or delay in performance caused by an Event Outside Our Control. Our obligations are suspended for the duration of such event.

Each section of these Terms operates separately. If any section (or part) is unlawful or unenforceable, the remaining sections remain in full force. If a section would be lawful with deletion of part, it shall apply with that deletion.

If we do not insist upon your performance or delay enforcing our rights, we do not waive those rights. Any waiver will be in writing and does not waive later defaults.

We may perform obligations or exercise rights under a Contract ourselves or via third parties. We may transfer our rights and obligations to another organisation; this will not affect your rights. You may transfer your rights/obligations only with our written consent.

These Terms are governed by the laws of the Republic of Ireland. The Irish courts have non-exclusive jurisdiction.
